The EB-2 National Interest Waiver (NIW) is a United States immigrant program through which experienced pilots obtain an unconditional green card for themselves and their family. The NIW waives the usual job offer and labor certification requirement, and an applicant must meet at least three listed criteria, such as 10 years of full-time experience as a pilot, a professional license, an aviation-related qualification, or membership in a pilot professional association. A spouse, including a same-sex spouse, and children under 21 can be included as dependents.
Green card holders may live, work, and study in the USA and have a pathway to citizenship after five years of residence. The NIW has a processing time of up to 24 months, with premium processing available for a fee under which USCIS responds within 45 days. After approval, applicants file for immigrant visas at a U.S. consulate, enter the USA within six months of issuance, and receive their green cards by mail.
