TL;DR Eligible highly skilled migrants can obtain permanent residency in Australia through the National Innovation Visa (NIV), a program designed to attract global entrepreneurs, researchers, and innovators. Unlike previous Australia skilled immigration pathways, the NIV does not require a points test or job offer, making it an attractive option for highly skilled migrants seeking a direct permanent residency pathway.
What is the National Innovation Visa (NIV)?
Australia’s National Innovation Visa (NIV) offers eligible applicants direct permanent residency in Australia. The NIV is aimed at highly skilled migrants from around the world including experienced professionals, entrepreneurs, researchers, and innovators whose expertise can contribute to Australia’s innovation economy. The program focuses on attracting talents capable of promoting innovation and economic growth.
While the program is invitation only, requiring applicants to submit an expression of interest (EOI) highlighting their achievements, the NIV has been designed to be selective while remaining accessible to individuals with promising background. The program highlights Australia’s intention to attract international talent and improve its reputation and attractiveness as a global hub for research, technology, and entrepreneurship.
Who Is Eligible for Australia’s National Innovation Visa?
Eligibility for the National Innovation Visa is subject to an individual’s experience, expertise, or innovative capacity to contribute meaningfully to Australia’s economy.
The National Innovation Visa operates under a priority framework that helps determine which highly skilled migrants will be invited to apply. Individuals are assessed based on their international achievements, nomination support, and alignment with Australia’s selected sectors.
The NIV program uses four Priority Categories to rank potential applicants. HLG presents a program that has been modelled around the unique needs of its clients. We will assess the client’s background against the local opportunities, and assess how they may qualify under the exclusive and fast-track Priority 2 Category: Candidates for any sector nominated on the approved Form 1000 by an expert Australian Commonwealth, State or Territory Government Agency.
The only higher priority category being for globally recognized experts who have received international awards or recognition in their field (such as Nobel Prize, Olympic medallists, etc). In general, principal applicants are expected to be between 18 and 54 years old. However, candidates outside this range may still qualify if they can demonstrate that their presence has the potential to deliver exceptional benefit to the Australian community.
Applicants should hold a university degree and have at least five years of professional experience in a field related to their qualifications. A functional level of English is generally required for adult applicants included in the application. This requirement can be waived through the payment of a government surcharge. This surcharge was introduced to allow the program to remain accessible to a wider selection of international talents.
All applicants, including dependents, must also meet Australia’s standard health and character requirements. Applicants will be required to complete medical examinations through an approved panel physician, and provide police clearance certificates from countries where the applicant has lived for a total of 12 months or more during the past ten years after turning 16.
What Are the Key Benefits of the Australia National Innovation Visa?
No Points System, No Job Offer, No Nationality Restrictions
There are no nationality restrictions, no points-based assessment, and no requirement for a job offer under the National Innovation Visa. Applicants are also not required to demonstrate business performance for visa approval or renewal.
In addition to providing direct permanent residency, the program offers support for establishing a new business or innovation project in Australia, helping applicants integrate into the country’s research and entrepreneurial ecosystem.
Full Support from Application to Business Setup
Investors are supported throughout the entire process, from assessing their background and identifying suitable project opportunities to securing nomination support from a reputable Australian entity.
Assistance is also provided with preparing and submitting the NIV application for the main applicant and their dependents, coordinating with an incubator to guide research and development, and establishing the new Australian company after visa approval.
Immediate Permanent Residency for You and Your Family
The NIV grants the main applicant and dependents immediate permanent residency upon approval, allowing them to live, work, and study in Australia indefinitely.
Can I Include My Children and Grandchildren in My NIV Application?
The National Innovation Visa allows applicants to include a wide range of family members as part of the same application. Australia recognizes both same-sex marriages and de facto (common-law) partnerships, meaning all family structures receive equal recognition under the program.
Eligible dependents can include a spouse or partner and dependent children. Adult children may also be included up to the age of 23 if they remain financially dependent. In cases where an adult child has a physical disability, there is no age limit for inclusion.
Grandchildren may also be included if they are the dependent child of an included child, allowing families to relocate to Australia across multiple generations under a single application.
Access to Medicare, Education, and Australian Public Services
As well as the business opportunities available, the NIV is also attractive to applicants and their families because it provides access to quality education and healthcare through Australia’s public healthcare system.
No Minimum Stay Requirement — Relocate at Your Own Pace
Importantly, the NIV does not impose any minimum physical stay requirement, allowing investors and their families to relocate to Australia immediately, or at their convenience to allow for a smoother personal and professional transition.
How to become an Australian citizen after receiving the NIV?
After four years of lawful residence, including at least one year as a permanent resident (and subject to conditions including basic English language proficiency, minimum residency, and good character requirements), each member of the family unit can become eligible for Australian citizenship.
How Much Do You Need to Invest for the Australia National Innovation Visa?
Under this pathway, the investor will establish and own 100% of a new Australian company and will be granted an incubation period of around two years. During this period, the project scope is refined, research and development partnerships are structured, and the appropriate team is assembled. Please note, while business and incubation support is available, the main applicant is expected to remain actively involved.
The minimum start-up investment is typically around USD 250,000.
How Long Does the Australia National Innovation Visa Take to Process?
The processing time for the NIV Priority 2 Category typically ranges from 8 to 15 months, depending on case complexity.
The process will begin with an initial due diligence and eligibility assessment, which usually takes around two weeks. This is followed by signing the incubation term sheet, securing nomination, and submitting the Expression of Interest, which generally takes about four weeks. Once an invitation is issued, the visa application must be prepared and submitted within 60 days.
After submission, processing times range from six to twelve months. Once approved, the applicant can travel to Australia to activate their permanent residency, establish the company, oversee research activities, and pursue the research, development and commercialization of their project.
