    EB2 Visa Requirements

    • Advanced degree: Bachelor’s degree + 5 years’ work experience in the same field.
    • The applicant’s work experience must include management experience.
    • The project must have substantial merit, be of national importance, and beneficial to the U.S.
    • Main applicant must demonstrate that they are innovative entrepreneurs and well-positioned to advance the venture.
    • Must provide proof of lawful source of funds used for the investment.

    The Start-up Investment Option

    • Start-up entrepreneur investment of at least 250,000 USD.
    • Research & Development: a significant part of the investment at least 30,000 USD) must be reserved for R&D.
    • Research and Development must be supported by governmentally backed U.S. research facilities.
    • Secure the commitments of a business incubator and U.S. Agencies.
    • Main applicant owns 100% of the legal entity conducting the business innovation project in the U.S.

      EB-2 stands for Employment Based Second Preference immigrant visa.

      Successful applicants will lawfully obtain a permanent status (green card) in the USA.

      The job offer (also called labor certification) is only required for the first 2 categories (EB-2 A and EB-2 B). A job offer is not required for the National Interest Waiver (“NIW”) category.

      The NIW allows the applicant to apply to the EB-2 program without having a valid job offer in the USA. In other words, the NIW waives the job offer requirement.

      To qualify, the applicant must demonstrate that 1) the project has substantial merit and national importance; 2) that the applicant is well-positioned to conduct the project; and 3) it would be beneficial to the USA to waive the requirement of a job offer. 

      The I-140 is the name of the Form an applicant must submit when filing the EB2 application. 

      No, there is no language requirement. However, ability to communicate in English would include being well-positioned to conduct the project.

      Yes. The applicant must hold at least a bachelor’s degree to apply for the EB-2 SUV USA stream. On top of the bachelor’s degree, the applicant must have at least 5 years of work experience (same field as the diploma). The applicant’s work experience must include management experience. 

      Industry/sector is not restricted as long as it is in line with the applicant’s diploma and work experience. Applicants may develop innovative business ideas in sectors such as information, technology, healthcare, finance, communication, energy, utilities, real estate (this list is non-exhaustive).

      Not under the SUV offer. The business incubator and the support of U.S. Agencies are required to meet the criteria of substantial merit and national importance.

      It means that USCIS will consider the applicant’s skills and knowledge as well as their business track record to determine if they can successfully conduct the intended innovative business in the USA. Ability to communicate in English would include being well-positioned to conduct the project.

      No. Only after the approval of the application, will the applicant be required to go to the USA.

      Yes. The applicant will receive the full USD 250,000 investment back. 

      The funds are not invested before the submission. Instead, the funds must be transferred to an escrow account and stay committed to the project during the adjudication of the application.

      There is no minimum requirement.

      Empowered Startups will not take any equity/ shares in the venture. The main applicant will own 100% of the venture. 

      After the approval of the application. 

      Bankruptcy does not affect the applicant’s green card (permanent status) in the USA.

      At the Empowered Startups U.S. office, located in Pullman, Washington State. 

      At Washington State University and at the University of Idaho.

      The incubation term is 12 months.
